Registration of Companies Security Interests (Company Charges)

The Government is seeking views on the impact, cost and benefits of possible changes to the law relating to companies’ security interests in particular whether to implement in England and Wales the recommendations made by the Law Commission and in Scotland the recommendations made by the Scottish Law Commission.

The two Commissions’ proposals are different. This reflects the fact that the underlying law relating to rights in security and the law of property in the respective jurisdictions are different. Three options are described in the attached document.
