This consultation seeks comments from organisations and individuals with an interest in the development of guidance relating to the statutory decommissioning scheme for offshore renewable energy installations in the Energy Act 2004.
The Energy Act 2004 introduces a decommissioning scheme for offshore wind, wave and tidal energy installations. Under the terms of the Act, the Secretary of State may require a person who is responsible for one of these installations to submit (and eventually carry out) a decommissioning programme for the installation. The Government is developing guidance on the operation of the scheme. This consultation paper seeks comments on the proposed content of that guidance.
The scheme, as set out in the Energy Act 2004, applies to territorial waters in or adjacent to England, Scotland and Wales (between the mean low water mark and the seaward limits of the territorial sea) and to waters in the UK Renewable Energy Zone (including that part adjacent to Northern Ireland territorial waters). The consultation therefore applies to England, Scotland, Wales and Northern Ireland.
