National minimum wage and the accommodation offset - Consultation on proposed guidance

The document has been produced in response to a recommendation of the Low Pay Commission in their 2006 report to update guidance on the accommodation offset.

The Government is seeking views on whether the guidance set out below explains the accommodation offset provisions of the national minimum wage legislation in a sufficiently clear and comprehensive manner to meet the needs of employers, workers and other interested parties.

The Government welcomes views from employers, workers, trade unions, interested and representative bodies and individuals.

The guidance relates to England, Scotland, Wales and Northern Ireland, except in so far as it refers to the Agricultural Minimum Wage.  Separate Agricultural Wages Orders apply in England and Wales, Scotland and Northern Ireland.

The amount that an employer providing accommodation can count towards national minimum wage pay is currently £3.90 per day (up to a maximum of £27.30 per week).  For simplicity, in the guidance we have used the rates which will be applicable from 1st October 2006 in all our calculations.  For the accommodation offset, this will be £4.15 per day (up to a maximum of £29.05 per week)
