The European Grouping of Territorial Cooperation Regulation is a new and innovative instrument to facilitate economic and social cohesion through cross-border, trans-national or inter-regional co-operation actions by a Member State, their regions and local authorities. It does this by creating a legal framework under EU law allowing Member States and/or regions to conclude directly agreements with each other and create Groupings, an EGTC, which has legal personality. Although the main focus of the Regulation is the delivery of EU Structural Funds under the Cooperation Objective an EGTC can be formed when the Community finance is from an alternative fund or even if there is no Community finance, provided the tasks to be carried out by the EGTC are covered by the Regulation and a Member States enacting legislation.
The Regulation comes into force on the 1 August 2007. Each Member state needs to enact legislation before that date to give full effect of the Regulation. As the Regulation is only applicable to public bodies and is of a technical nature a full 12 week public consultation is not being held and is replaced by a 6 week technical consultation. In the EGTC technical consultation document the UK Government puts forward its proposed approach to the UK’s enacting legislation and invites views from those with an interest in the Regulation.
