Scrutinising New Regulations

The Government carefully considers the impact of any new regulations, before introducing them, to ensure any regulatory burden they add is kept to a minimum.

This work falls into two key areas: Impact Assessments (IAs) and Consultations.

Impact Assessments

Impact Assessments help policy-makers think through and understand the consequences of any interventions. They also enable the Government to identify which proposals will achieve their policy objectives, while minimising costs and administrative burdens.

Preparing and publicising IAs ensures those interested in certain policies understand and can challenge:

  • why the Government is proposing to intervene
  • how and to what extent new policies may impact on them
  • the estimated cost and benefits of proposed and actual measures.

IAs also give those interested in the process an opportunity to identify any potential, but unintended, consequences.

Consultations

Consultations are another essential part of the policy-making process, and the Government always listens to those who might be affected by new regulations, as well as experts in that area of policy.

This work helps the Government design effective solutions, increases the likelihood that new policies will meet their objectives and reduces the risk of unintended consequences.

The Code of Practice on Consultation, first launched in 2000, has improved the quality of Consultations. There is also guidance to help anyone carrying out a Consultation, which should be used alongside the Code.

The Better Regulation Executive has recently reviewed the Code of Practice on Consultations by seeking views on how it can be improved. This was to ensure it is as effective as it can be, and make any further enhancements.
