Working time case law and rulings

There are several important court decisions that have shaped working time in the UK, a summary of their impact in the workplace can be found on BIS.

Enforcement of the working time regulations

Enforcement of the working time regulations is split between different authorities. The limits on working time and health assessments of night workers are enforced by the:

  • Health and Safety Executive
  • Local authority environmental health departments
  • Civil Aviation Authority (CAA)
  • Vehicle and Operator Services Agency (VOSA)
  • Office of Rail Regulation (ORR)

The entitlements to rest and leave are enforced through Employment Tribunals.

Long Hours Working Partnership Project

In 2004 a partnership project between the former DTI (now BIS), CBI and TUC was set up in order to identify practical ways of implementing change management programmes in the workplace and share this learning between businesses

Business champions who have successfully implemented working time change management programmes shared their learning in master classes. These case studies were written up into a report.
