Packaging and Packaging Waste Directive 94/62/EC

 

Packaging legislation is driven by the Packaging & Packaging Waste Directive (94/62/EC) - 'The Packaging Directive' – which is concerned with minimising the creation of packaging waste material and promotes energy recovery, re-use and recycling of packaging.  In the UK this is implemented through the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (as amended) and the Packaging (Essential Requirements) Regulations 2003 (as amended).  Responsibility for these is split between the Department for the Environment, Food and Rural Affairs (Defra) and the Department for Business, Enterprise & Regulatory Reform (BERR).

1. Latest Information

July 2009

The Packaging (Essential Requirements) (Amendment) Regulations 2009 came into force on the 10th of July 2009.

This extends indefinitely the time limited Commission Decision 1999/177/EC, which established a derogation for plastic crates & pallets containing heavy metal concentrations, which expired on 4 March 2009. It will be reviewed by the Commission in 5 years.

June 2009

Making the Most of Packaging - a strategy for a low carbon economy, has been published by Defra, with input from BIS and the Devolved Administrations. It considers the direction for packaging policy for the next ten years.

March 2007The Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (SI 2007 No. 871) came into force on 16 March 2007. These replace all earlier iterations. Details of the Explanatory Memorandum can be found here.

January 2007: Packaging (Essential Requirements) Regulations – government guidance notes 2007 have been published.  This replaces the May 2004 guidance (URN 05/713).

July 2006 : An existing derogation - due to expire on 30 June 2006 for glass packaging in relation to the heavy metal content was extended indefinitely by Commission Decision 2006/340/EC and its provisions were transposed into UK law by the Packaging (Essential Requirements Amendment) Regulations 2006.
